The Title IX court case against Ithaca College and Bryan Roberts, former associate dean of the Roy H. Park School of Communications, has closed after a stipulation of voluntary dismissal with prejudice was filed May 3. This means the parties involved in the case mutually agreed to permanently end the lawsuit.
The case was dismissed under the Federal Rule of Civil Procedure 41(a)(1)(A)(ii), which allowed the case to be dismissed without a court order as long as there was an agreement in writing from both parties. The case has been open since November 2023 which makes the case 18 months long. With the terms of the dismissal, the plaintiff cannot bring the same claim forward in the future making this closing of the case final.
On Feb. 26, the court allowed the parties to file a status report or stipulation of dismissal after the Feb. 24 mandatory mediation session in which the parties came to an agreement to settle the case and submit it for court consideration. Since then, the parties have worked out the stipulation with their legal teams.
The stipulation of voluntary dismissal was signed by the plaintiff’s attorney Erin Peake, Ithaca College’s attorney Thomas S. D’Antonio and Roberts’ attorney Ashley R. Westbrook.
